1. Eligibility

You must be at least 13 years old to use EatOut AI (16 in some regions, including the EU). To join the Wellness Ambassador program, you must be at least 18 years old and have legal capacity to enter into a contract.

2. Your Account

• You are responsible for keeping your password secret.
• You are responsible for any activity that happens under your account.
• You may only create one account. Multiple accounts created to abuse promotions or referral rewards may be suspended.

3. Services

EatOut AI provides:

• AI-powered restaurant and meal recommendations
• Menu scanning technology
• Wellness goal tracking
• Restaurant discovery
• Subscription-based premium features
• A community Wellness Ambassador program

4. Subscriptions, Trials & Billing

• Some features require a paid subscription.
• Subscriptions automatically renew at the end of each billing period unless canceled.
• Free trials convert into paid subscriptions unless canceled before the trial ends.
• Pricing is shown clearly before purchase.
• You can cancel anytime from inside the app, from your Apple/Google subscription settings (for in-app purchases), or by emailing support@eatoutai.com.
• We do not refund prorated portions of a subscription period except where required by law.
• If a payment fails, your account may enter a brief grace period before access is paused.

5. SMS & Email Communications

By providing your phone number and email, you consent to receive account notifications, subscription reminders, healthy eating recommendations, restaurant updates, and promotional messages. Message and data rates may apply. Reply STOP to unsubscribe from SMS or use the unsubscribe link in any email.

6. AI & Wellness Disclaimer

EatOut AI provides informational wellness recommendations only and does not provide medical advice, diagnosis, or treatment. AI-generated nutrition estimates may be inaccurate. Consult a qualified healthcare professional regarding medical or dietary decisions, especially if you have allergies, medical conditions, or are pregnant.

7. Restaurant Information

Restaurant menus, calorie estimates, pricing, hours, and availability may not always be current or accurate. Verify critical details (allergens, pricing, opening hours) with the restaurant directly.

8. User Conduct

You agree not to:

• Misuse the platform or interfere with its operation
• Attempt unauthorized access to other accounts or systems
• Upload harmful, illegal, infringing, or sexually explicit content
• Scrape, mirror, or reverse-engineer the platform without written permission
• Use the app to spam other users or to send unsolicited messages

9. Ambassador Program

If you join the Wellness Ambassador program, additional terms apply. See the Ambassador Program Terms for the full rules covering commissions, payouts, prohibited conduct, and tier eligibility.

10. Suspension & Termination

EatOut AI may suspend or terminate any account that violates these Terms, abuses our platform, generates fraudulent referrals, or causes harm to other users. Suspension may include withholding pending commissions earned through prohibited behavior.

11. Self-Service Account Deletion

You can permanently delete your account at any time from within the app or at https://eatoutai.com/delete-account/. No email to support is required. See our Privacy Policy for what is erased vs. retained for legal compliance.

12. Intellectual Property

All EatOut AI software, branding, and content are owned by us or our licensors. You retain ownership of content you upload (such as menu photos and reviews), but grant us a non-exclusive license to use that content to operate and improve the service.

13. Limitation of Liability

EatOut AI is provided "as is" without warranties. To the maximum extent permitted by law, EatOut AI is not liable for:

• Restaurant experiences or food quality
• Health outcomes or allergic reactions
• Inaccurate AI recommendations or nutrition estimates
• Service interruptions or data loss
• Third-party actions, including those of other ambassadors

14. Governing Law & Disputes

These Terms are governed by the laws of the United States and the Commonwealth of Massachusetts (without regard to conflict-of-law rules). Any dispute will be resolved through binding arbitration in Worcester, MA, or in small-claims court where applicable.

15. Changes to Terms

EatOut AI may update these Terms periodically. Material changes will be communicated by email or in-app notice. Continued use of the platform after the effective date constitutes acceptance.
